These terms comply with Canadian regulations regarding drone operations.
1. Services Provided
SkySavage Films and Chad Peddle provide professional aerial photography and videography services as detailed in the Drone Services Agreement.
2. Flight Operations and Safety
We operate according to Transport Canada CARs Part IX regulations. Operations are subject to airspace approvals where applicable.
The pilot in command has final authority to cancel or postpone a flight due to safety risks, adverse weather (high winds, rain, snow, extreme cold temperatures), or potential violations of airspace rules.
3. Client Responsibilities
The client must ensure legitimate access to the site.
The client is responsible for informing personnel on-site regarding filming and agrees that they have received consent from all affected personnel to be captured on film. If the flight captures personal information, we adhere to PIPEDA guidelines regarding data privacy.
4. Payment and Cancellation
Please see our Refund Policy for this information.
5. Copyright and Licensing
SkySavage Films retains full copyright of all aerial footage and photography produced.
Upon full payment, the client is granted a perpetual, non-exclusive, non-transferable, royalty-free license to use the footage for their own business promotion, media, print, marketing, and website use.
The client may not sell or sublicense the footage, or allow any third party to use the footage, without prior written consent.
SkySavage Films reserves the right to use any video footage or photos for our own promotional purposes, on our website, on our social media accounts, in advertisements or printed material as desired.
6. Limitation of Liability
SkySavage Films maintains necessary insurance for third party liability. Total liability is limited to the total value of the contract.
We are not responsible for delays or losses caused by weather, airspace restrictions, or site access issues.
7. Governing Law
This agreement is governed by the provincial laws of Ontario and the federal laws of Canada. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
